In this important work, Dr. Felipe Fierro offers a comprehensive view on the subject of Introduction to the Study of Law, in which he revives the use of Gnoseology, Philosophy, History and Logic as Auxiliary Sciences; and exposes how the abandonment of such has contributed to the exponential growth of Skepticism and Relativism, currently prevailing in the legal world. Morality and Legal Law are obligatory markers, which although considered in their own field, are not excluded, but different as to object and method. Predominantly, Justice is exposed as one of the great values of the Law, and main theories in order to offer future lawyers the basis regarding the current Science of Law and its significance. Aversive autobiographical memories sometimes prompt maladaptive emotional responses and contribute to affective dysfunction in anxiety and depression. One way to regulate the impact of such memories is to create a downward counterfactual thought–a mental simulation of how the event could have been worse–to put what occurred in a more positive light. Despite its intuitive appeal, counterfactual thinking has not been systematically studied for its regulatory efficacy. In the current study, we compared the regulatory impact of downward counterfactual thinking, temporal distancing, (...) and memory rehearsal in 54 adult participants representing a spectrum of trait anxiety. Participants recalled regretful experiences and rated them on valence, arousal, regret, and episodic detail. Two to six days later, they created a downward counterfactual of the remembered event, thought of how they might feel about it 10 years from now, or simply rehearsed it. A day later, participants re-rated the phenomenological characteristics of the events. Across all participants, downward counterfactual thinking, temporal distancing, and memory rehearsal were equally effective at reducing negative affect associated with a memory. However, in individuals with higher trait anxiety, downward counterfactual thinking was more effective than rehearsal for reducing regret, and it was as effective as distancing in reducing arousal. We discuss these results in light of the functional theory of counterfactual thinking and suggest that they motivate further investigation into downward counterfactual thinking as a means to intentionally regulate emotional memories in affective disorders. In this paper we argue that defenders of Frankfurt-style counterexamples to the Principle of Alternative Possibilities do not need to construct a metaphysically possible scenario in which an agent is morally responsible despite lacking the ability to do otherwise. Rather, there is a weaker (but equally legitimate) sense in which Frankfurt-style counterexamples can succeed. All that's needed is the claim that the ability to do otherwise is no part of what grounds moral responsibility, when the agent is indeed morally responsible.

Most people's intuitive reaction after considering Nozick's experience machine thought-experiment seems to be just like his: we feel very little inclination to plug in to a virtual reality machine capable of providing us with pleasurable experiences. Many philosophers take this empirical fact as sufficient reason to believe that, more than pleasurable experiences, people care about “living in contact with reality.” Such claim, however, assumes that people's reaction to the experience machine thought-experiment is due to the fact that they value reality (...) over virtual experiences—an assumption that has seldom (if ever) been questioned. This paper challenges that very assumption. I report some experimental evidence suggesting that the intuition elicited by the thought-experiment may be explainable by the fact that people are averse to abandon the life they have been experiencing so far, regardless of whether such life is virtual or real. I use then an explanatory model, derived from what behavioral economists and psychologists call the status quo bias, to make sense of these results. Finally, I argue that since this explanation also accounts for people's reaction toward Nozick's thought-experiment, it would be wrong to take such intuition as evidence that people value being in touch with reality. Consider three widely shared claims that have not been discussed vis-à-vis one another. In his Proslogion, Saint Anselm argued that the claim “God exists” is true. If an intuition that a claim c is a useful a-priori justificatory resource, this can only be because such an intuition is a justification that c is true. And if an intuition that c is a justification that c is true, c can stand, not only for mathematical or logical claims, but also for controversial (...) philosophical ones, e.g., “God exists”. This essay addresses to while dialoguing with the literature on Anselm and intuition and articulating an alternative reading of the Proslogion. The alternative reading is that regardless of whether the Proslogion backs up or aims to back up the claim that “God exists” is true, it implicitly articulates the Meaning Argument whose conclusion is that all persons of faith are able to understand that the claim “God exists” is meaningful. This argument, it is argued, is evidence that an intuition that c may be a useful a-priori justificatory resource even if such intuition does not track truth, but merely meaning in being a justification for taking c to be meaningful. It is also supported that an intuition that “God exists” is not a justification that this claim is true. This is an indication that there may be reasons for thinking that the same applies to other controversial philosophical claims. (shrink)

Recently, much attention has been given to Buddhism as a precursor to contemporary holistic theories, and more specifically to the Huayan school’s radical holistic metaphysics (often given the metaphorical name of The Net of Indra), as well as to Huayan’s most elaborate theoretician, Fazang. Nevertheless, contemporary interpretations of Fazang have been weighted by either too strict an adherence to atomistic logic or by unfortunate translations. In this paper, I present new translations of the key passages of Fazang’s The Rafter Dialogue, (...) as well as a philosophical commentary that his departure from atomism. I then proceed to argue that the six characteristics Fazang attributes to a whole that cannot be reduced to its parts are both sufficient and necessary for holism. (shrink)

The reward system of science is the priority rule. The first scientist making a new discovery is rewarded with prestige, while second runners get little or nothing. Michael Strevens, following Philip Kitcher, defends this reward system, arguing that it incentivizes an efficient division of cognitive labor. I argue that this assessment depends on strong implicit assumptions about the replicability of findings. I question these assumptions on the basis of metascientific evidence and argue that the priority rule systematically discourages replication. My (...) analysis leads us to qualify Kitcher and Strevens’s contention that a priority-based reward system is normatively desirable for science. (shrink)

In this paper I offer a critical reading of some aspects of Heidegger’s late philosophy and evaluate how these relate to his nationalist claim that we need to stay rooted in the soil of our homeland. In response to this claim, Žižek suggests thet being-rootless is the primordial state of being-human and that what we represent as our roots are secondary attempts to obfuscate this dimension. First, I will present Heidegger’s philosophy of technology to elucidate his thesis that the essence (...) of modern technology determinates the way we come to experience the totality of beings in our times as “standing reserve”. In the second section, I expound his aesthetics where art is seen as a mode of approaching entities that follows a different logic to that of the Gestell. However, this analysis of Heidegger’s philosophy of art will reveal a political dimension to the concept of earth which I take to be a reactionary attempt to neutralize the eventual dimension of the Gestell. In the third section, I offer a critical re-interpretation of Heidegger’s philosophy following Žižek’s clue. I argue that modern art is characterized by its self-reflexive character which can be deemed transcendental once we accept the ontological dimension of art following Heidegger. These works offer a rooting in our own rootless condition analogous to the grounding in the Abgrund of Hegel’s absolute knowledge. Finally, I offer an analysis of Quentin Tarantino’s Inglorius Basterds from the perspective of the conceptual framework developed in the previous pages. (shrink)

Chesterton en su corto ensayo Aproximación al tomismo quiere resumir los descarríos o los logros de los sabios sobre la realidad, muestra las tres controversias generales del pensamiento: (1) la disolución de las cosas en las soluciones químicas del escepticismo, que es la controversia entre el flujo o la transición informe; (2) la difícil clasificación de las unidades ideales, que es la controversia entre realismo y nominalismo; y (3) el reconocimiento, también arduo, de la variedad cuando a (...) la vez se admite la unidad, que es el viejo acertijo metafísico de la unidad y lo múltiple. This paper addresses two methodological paths in Artificial Intelligence: the paths of Babbage and anti-Cartesianism. While those researchers who have followed the latter have attempted to reverse the Cartesian dictum according to which machines cannot think in principle, Babbage’s path, which has been partially neglected, implies that the replacement of humans—and not the creation of minds—should provide the foundation of AI. In view of the examined paths, the claim that we support here is this: in line with Babbage, AI researchers (...) have recently concentrated upon the replacement of human labour, and thus upon the creation of Machine Learning systems. After presenting and analysing the paths, we characterise Machine Learning via its developments and an illustrative example. Then, we put forward an argument that shows that total replacement of human labour will not be feasible for practical and conceptual reasons despite the successful developments in recent AI systems. Our discussion finally leads to optimism and awareness: AI’s advances allow humans to dedicate themselves to higher level tasks, but these advances also require that we be vigilant about the responsibilities granted to ML-based systems. En este artículo se desarrollan las consideraciones heideggerianas acerca de la corporalidad expuestas en Zollikoner Seminare, atendiendo a la posición fundamental desde la cual estas se despliegan. Se discute acerca de la necesidad, por parte de Heidegger, de abordar el problema del cuerpo vivo al margen de las consideraciones científicas y, por consiguiente, se enfatiza el sentido íntimo de un eventual "6cambio de método" que pareciera conducir la reflexión sobre el cuerpo a la aclaración de su modo de ser propio, (...) con el fin de clarificar cómo es que aquel puede ser entendido como un existencial. The article examines Heidegger´s considerations of corporeality in the Zollikon Seminars, focusing on the fundamental position from which they are made, and discusses Heidegger´s need to address the issue of the living body separately from scientific considerations. Therefore, it emphasizes the profound meaning of a possible "change of method" that seems to lead the reflection on the body toward the clarification of its inherent mode of being, in order to explain how it can be understood as an existential. Neste artigo, desenvolveram-se as considerações heideggerianas sobre a corporalidade expostas em Zollikoner Seminare, atendendo à posição fundamental a partir da qual estas se realizam. Discute-se sobre a necessidade, por parte de Heidegger, de abordar o problema do corpo vivo à margem das considerações científicas e, consequentemente, enfatiza-se o sentido íntimo de uma eventual "mudança de método" que parece conduzir a reflexão sobre o corpo ao esclarecimento de seu modo de ser próprio, com o objetivo de esclarecer como aquele pode ser entendido como um existencial. It’s constitutive of classical theism that there is a necessarily existent personal god who is also the creator of the universe, where the latter claim includes at least the following three theses: (i) God is wholly distinct from the natural world; (ii) God is the originating or sustaining cause of the natural world; and (iii) God created the natural world ex nihilo, i.e., without the use of pre-existing materials. Call this tripartite component of classical theism the classical view of creation. (...) In this paper, I offer a new argument against classical theism. In particular, I argue that creation ex nihilo is prima facie impossible, and that since the doctrine of creation ex nihilo is constitutive of classical theism, classical theism is false. (shrink)

The experimental interventions that provide evidence of causal relations are notably similar to those that provide evidence of constitutive relevance relations. In the first two sections, I show that this similarity creates a tension: there is an inconsistent triad between Woodward’s popular interventionist theory of causation, Craver’s mutual manipulability account of constitutive relevance in mechanisms, and a variety of arguments for the incoherence of inter-level causation. I argue for an interpretation of the views in which the tension is merely apparent. (...) I propose to explain inter-level relations without inter-level causation by appealing to the notion of fat-handed interventions, and an argument against inter-level causation which dissolves the problem. The logos’ question, one of the most important among the subjects that traverse the Plato’s Sophist, has in fact some different aspects: the criticism of father Parmenides’ logos, that is unable to speak about the not-being, but also about the being; the relations between logos and its cognates, phantasia, doxa and dianoia; the logos’ complex structure, that is a compound with onoma and rema; the difference between naming and saying, two distinct but inseparable actions; the logical and ontological conditions that (...) make possible to say the truth, or to lie or simply to joke; the necessity of a most flexible logos that allows us to speak about the not-being, and about the being, but at the same time is a logos dangerously similar to the sophist’s one; finally, the identity between the power to produce “spoken images” and the very power to speak. The aim of the present article is giving a systematical view of the matter that grasps all these faces. (shrink)

This paper makes a conceptual prescription: it argues that judges and lawyers should adopt a positivist concept of law, on normative grounds. The positivist view, I will argue, is more consistent with reasonable disagreement and majority rule than nonpositivist views, offers a better view of law’s moral standing, and is more consistent with what Dworkin called ‘integrity’ than non-positivism. As the paper explains, this is an argument about what I call the ‘operative’ concept of law. As such, the argument avoids (...) potential problems for conceptual prescription, and shows why even those who adopt non-positivist views about the nature of law might accept it. (shrink)

This study provides a thorough exegesis of the names of metaphysics according to the proem of the Disputationes metaphysicae by Francis Suarez. The key to its consideration lies in the simultaneous unity between this science and the names assigned to it mainly by Aristotle. Due to the scant attention devoted to this work, this study emphasizes that the epistemic unity of metaphysics is given beforehand –prior to the final consideration and determination of its proper object, which is the entity insofar (...) real entity– by the complementarity of the different perspectives each name of metaphysics denotes. RESUMEN Se discute la posibilidad de comprender la presencia sensible del mundo y de una caracterización existencial de las cualidades sensibles según las cuales este comparece desde el punto de vista de los análisis heideggerianos del existir humano o Dasein. Pese a las ocasionales referencias a dicho problema en el pensamiento de Heidegger, se enfatiza que la relación fáctica del existir con el ente inmediato radica en un hallarse concernido del propio Dasein. Se analiza el papel de las cualidades sensibles (...) como una exhortación a establecer tratos fácticos con lo ente que permiten al existir concreto vivir en una confrontación con las cosas de su entorno, entendiendo que el ente intramundano solo es tal en el interior de una totalidad remitiva. Se advierte que el problema de lo sensible en términos existenciales puede ser descrito desde la manera de ser del Dasein, como quien es exhortado por las cosas entre las cuales vive. ABSTRACT The article discusses the possibility of understanding the sensible presence of the world and attempts an existential characterization of the sensible qualities according to which it appears, from the perspective of Heidegger's analyses of human existence or Dasein. Despite the occasional references to that issue in Heidegger's thought, the paper states that factual relation between existence and the immediate entity is based on Dasein's being concerned. It analyzes the role of sensible qualities as an exhortation to establish factual dealings with entities that allow Dasein to engage with that which surrounds it, bearing in mind that the entity-within-the world is such only within a context of reference. The article also suggests that, in existential terms, the problem of the sensible can be described on the basis of Dasein's way of being as exhorted by the things among which he lives. (shrink)

Do we have control over the content of our imaginings? More precisely: do we have control over what our imaginings are about? Intentionalists say yes. Until recently, intentionalism could be taken as the received view. Recently, authors like Munro & Strohminger (2021) have developed some arguments against it. Here, I tentatively join their ranks and develop a new way to think about the way in which imaginings develop their contents that also goes against intentionalism. My proposal makes use of what (...) we may call a ballistic framework for mental dynamics, which I sketch to some length. In this model, imaginings are articulated by ballistic events sensitive to constraints that modify the trajectories that imaginings trace in a special working space. This framework leaves room for alternatives to pre-assigned-content models, such as Kung’s (2016). In the ballistic-based models sketched here, and against intentionalism, imaginings can fail to be about what we intend them to be about. The framework also has applications beyond the intentionalism debate, some of which I will sketch. (shrink)

This paper is focused on dismissive metaontological views about ontology. The paper's first section deals with radical dismissivism: a view which I interpret as Carnap's. The second section approaches moderate dismissivism: a view which I interpret as Hirsch's. My first claim is stated in section three: that there are significant differences between the mentioned authors. However, current literature on metaontology, not only does not emphasize such differences, but also insinuates that they do not exist. The authors I have in mind (...) here are Eklund and Bennett. In the fourth section, I compare Carnap's radical dismissivism with Hirsch's moderate dismissivism. My second claim is stated in section five: that Carnap's radical dismissivism is more persuasive than Hirsch's moderate one. (shrink)

Research has shown that experiences of discrimination cause harm to the health and well-being of people. In terms of the identity of members of a group, a positive evaluation of that group might involve devaluing the out-group as a way of raising the endo-group, causing discrimination toward the out-group. In the Chilean context, the Mapuche people have historically suffered discrimination and violations of their rights. The aim of this study was to assess the relationship between Collective Identity, perceived experiences of (...) discrimination, psychological well-being and distress in the inhabitants of the Mapuche conflict zone according to their sense of belonging to their ethnic group. This descriptive, correlative, and cross-sectional study involved 200 participants, including 94 men, and 106 women, between the ages of 18 and 83 years old, who had lived for at least 1 year in communities in the Araucanía Region. The sample was stratified according their sense of ethnic identity, including 30% Mapuche, 33.5% Caucasian, and 36.5% Mestizo. The results show that participants with a sense of Mapuche ethnicity experienced more instances of discrimination, had a greater sense of collective identity, and that they also supported the Mapuche social movement and its methods. Based on evidence that well-being is directly related to collective identity, the study undertook a regression analysis of emotional distress and the psychological well-being of participants. The interaction between experiences of discrimination and collective identity has a significant influence. Collective identity and experiences of discrimination in themselves as well as the interaction between them, predict psychological well-being. The results suggest that the importance of the Mapuche group’s identity phenomena are related to a broad socio-historical context that leads them to identify themselves as a collective in conditions of inequality. This relationship between well-being and collective identity could be explained by their sense of cultural belonging, which can be a factor in protecting mental health. (shrink)

In the philosophy of memory there is a tension between a preservationist and a constructivist view of memory reflected in the debate between causalism and simulationism. Causalism is not only committed to the claim that there must be an appropriate causal connection between the remembered event and the content represented at retrieval but also that such connection is possible because of a content-preserving memory trace. Simulationism, by contrast, rejects the need for an appropriate causal condition and, thereby, makes the appeal (...) to memory traces unnecessary. In this paper I argue that while the are strong conceptual arguments and empirical evidence to support a constructivist view of memory, the empirical evidence also suggest that the initial formulation of simulationism needs to be revised. In particular, I argue, first, that simulationism’s commitment to a single cognitive system for mental time travel is likely wrong, and second, that simulationism cannot get rid of memory traces altogether, as they are still explanatorily indispensable when it comes to explaining a large number of memory-related phenomena. At the end, I end up suggesting a way of thinking about memory traces that, I think, is compatible with simulationism and a constructivist view of memory. If the view I put forth is on the right track, then an updated version of simulationism can help to dispel the dichotomy between causalism and simulationism as a false one. (shrink)

We live in an era where our health is linked to that of others across the globe, and nothing brings this home better than the specter of a pandemic. This paper explores the findings of town hall meetings associated with the Canadian Program of Research on Ethics in a Pandemic , in which focus groups met to discuss issues related to the global governance of an influenza pandemic. Two competing discourses were found to be at work: the first was based (...) upon an economic rationality and the second upon a humanitarian rationality. The implications for public support and the long-term sustainability of new global norms, networks, and regulations in global public health are discussed. (shrink)

The coronavirus disease 2019 pandemic is altering dynamics in academia, and people juggling remote work and domestic demands – including childcare – have felt impacts on their productivity. Female authors have faced a decrease in paper submission rates since the beginning of the pandemic period. The reasons for this decline in women’s productivity need to be further investigated. Here, we analyzed the influence of gender, parenthood and race on academic productivity during the pandemic period based on a survey answered by (...) 3,345 Brazilian academics from various knowledge areas and research institutions. Productivity was assessed by the ability to submit papers as planned and to meet deadlines during the initial period of social isolation in Brazil. The findings revealed that male academics – especially those without children – are the least affected group, whereas Black women and mothers are the most impacted groups. These impacts are likely a consequence of the well-known unequal division of domestic labor between men and women, which has been exacerbated during the pandemic. Additionally, our results highlight that racism strongly persists in academia, especially against Black women. The pandemic will have long-term effects on the career progression of the most affected groups. The results presented here are crucial for the development of actions and policies that aim to avoid further deepening the gender gap in academia. (shrink)

Resumen Este artículo se propone pensar el ensimismamiento característico de la melancolía en vistas a comprender su particular endon. Siguiendo las discusiones que ha mantenido la psiquiatría fenomenológica con las tesis heideggerianas sobre el miedo y la angustia, intentaremos mostrar que la melancolía, pese a poder ser entendida como un retraimiento del mundo y como una relación consigo mismo de autorreproche, puede ser pensada también como una condición vital que radicaría en un movimiento de autoanulación albergado en la propia relación (...) del existir consigo, mientras se despliega en el mundo. Así, se esbozará una reflexión en la que la melancolía pueda ser entendida como una aporía a partir de las consideraciones kierkegaardianas sobre la desesperación en cuanto enfermedad mortal.This paper aims to think about the characteristic self-absorption of melancholy to understand its particular endon. Following the discussions that phenomenological psychiatry has maintained with heideggerian theses about fear and anguish, we will try to show that melancholy, despite being understood as a withdrawal from the world and as a reproachful relationship with oneself, can also be thought as a vital condition that resides in a movement of self-annulment housed in the own relation of existence to oneself, while this one unfolds in the world. Thus, it will be outlined a reflection in which melancholy can be understood as an aporia from the Kierkegaard's considerations on despair as a deadly disease. (shrink)

La ciencia a lo largo de su historia ha estado fundamentada por múltiples enfoques filosóficos, sin embargo, han existido dos tradiciones hegemónicas que componen el dualismo de la investigación cualitativa y cuantitativa. En este artículo, además de criticar dicho dualismo, se propone una ontología alternativa de investigación cualitativa que supere el reduccionismo subjetivista. Para ello, se considera la concepción de la realidad de Max Scheler. En dicha nueva ontología, la ciencia cualitativa estudiaría un mundo compuesto por aspectos objetivos y subjetivos. (...) RESUMEN A partir de los análisis de la cosa perceptiva en la obra de Husserl, se indagará el mundo material como suelo en el cual nuestra vida práctica se sostiene. A partir de sus objeciones al empirismo de Locke, se cuestiona la certeza de la actitud natural sobre la aceptación de una realidad autónoma, para rebatir la noción de un mundo en sí que nos afecta. De este modo, un examen del mundo fenoménico señala que su materia es una dimensión (...) no homogénea ni completa, subrayando una estable variación de las cosas. Con ello, se detecta una ambigüedad esencial según la cual estas se nos ofrecen como apoyo de nuestra praxis. ABSTRACT From Husserl's analysis of the thing perceived, the material world will be investigated as the ground where our practical life is sustained. From Husserl's objections to Locke's Empiricism, the certainty of the natural attitude about the acceptance of an autonomous reality will be questioned, to refute the notion of a world in itself that affects us. Thus, an examination of the phenomenical world will point out that its matter is a non-homogeneous and non-complete dimension, by stressing a stable variation of things. This will reveal an essential ambiguity, according to which the things are offered to us as support for our praxis. (shrink)
